In this article we will go over some ways to use Silvertrac as a secondary way to document your Company's compliance policies of providing meal breaks and rest periods through the Mobile Device Login Message feature, acknowledging reminders through the Tasks feature and including the Company's compliance policies in the Property Notes/Post Orders.

Why is Secondary Compliance Documentation Necessary? The New Target for "Ambulance Chaser" Litigation and Lawsuits

Most States require that employees must provide for specific rest and meal periods per specific hours worked i.e. a 10 to 15 rest period for each 4 hours worked and a minimum half hour meal period for each 8 hours worked.  

This is a very difficult Company policy to "enforce" since the vast majority of Security Officers work alone and are unsupervised most of the time.  A Security Officer's compliance in properly documenting their rest periods and meal breaks have been largely left to good faith or a paragraph in the signed employee handbook or employment contract. 

Secondary Compliance Documentation is becoming more and more necessary as real or perceived violations of these laws have been identified by watch groups as the new "ambulance chaser" for many lawyers looking to make a quick buck.   

In most cases, even if a Security Company owner had compliance policies in place, if they were unable to prove in court that the State Mandated breaks and meal periods had been taken, they have had to pay settlements and damages into the hundreds of thousands of dollars in litigation and lawsuits.  This has caused several legitimate Security Companies to go out of business.

Option 1:  Use the Mobile Device Login Message feature to document your company's compliance policies of providing meal breaks and rest periods that the User must acknowledge before they can do anything else with the App.

Hover over the System tab >> click System Config >> under the General tab find the Mobile Device Login Message and enter your message. 

Option 2: Create a Policy reminder that is date and time stamped when sent, received, and acknowledged through the Tasks feature.

Option 3: Include the Company's compliance policies in the Property Notes/Post Orders.

It is recommended that you utilize all three options to Document, Distribute and Remind Officers of Mandatory Meal Periods, Break Policies and Compliance.
